A renter wrote me a hot check for rent in Hays County, Texas. What do I need to do to get my $ back.?

The lease was an oral month to month lease. The hot check was written in October 2005. The renter no longer lives in my rental unit, but they know they wrote a hot check, and it appears they have decided not to make it good.

    It’s your responsibility to get the money back the bank has no reponsibility for that. Go to the police and file a complaint and hopefully they will help you out with getting your money back.

    You could file a civil law suit in small claims court. If he does not show you get get a default judgment placed against him. The court could order garnishment or a lien placed on money owed to him.

    You probably will have to go to small claims court. Check with the police in your area and file a complaint.
